San Marcos First Offense DUI/DWI Lawyer
If you or a loved one faces a first-time DUI or DWI charge, the ground can feel like it has shifted beneath you, and the decisions made in the next few days matter more than most people realize. As a San Marcos first offense DUI/DWI lawyer, I work to help you understand what you are facing and what options exist.
If someone you care about was arrested for driving under the influence near Texas State University or anywhere in the San Marcos area, the time to act is now, not after the court date arrives.
Call Richard Ursha, Attorney at Law at (512) 551-1179 today to schedule a free case evaluation.
What Happens After a First DWI Arrest in Texas?
A DUI/DWI conviction, even a first one, can mean fines, a suspended license, mandatory education programs, and a permanent mark on a criminal record that follows a person into job applications, graduate school admissions, and professional licensing.
The First 15 Days: Your ALR Hearing Is the Clock That Is Already Ticking
It is a common misconception that out-of-state drivers or students with licenses from other states can skip this step. If a student holding a license from California, Illinois, or another state is arrested in Central Texas and misses the 15-day ALR deadline, Texas DPS will suspend their privilege to drive within the state of Texas.
This suspension is then reported back to their home state through the National Driver Register, which frequently triggers a reciprocal suspension at home. We intervene immediately to request the ALR hearing, protecting driving privileges for both Texas residents and out-of-state students.
An arrest triggers two separate legal processes in Texas. One is the criminal case. The other is an administrative action by the Texas Department of Public Safety, called an Administrative License Revocation, or ALR hearing. You have 15 days from the date of arrest to request that hearing, or your license is automatically suspended.
This is where having a lawyer with insight into how the Texas justice system actually operates makes a real difference. I have worked for over 20 years as a criminal defense attorney and understand how to use these hearings strategically and for the best interests of you or the person you love.
